Terms of Service

1. Acceptance of Terms

By accessing or using InspectAndGo (“the Service”), operated by NT Development Group Pty Ltd (ABN: 41 660 399 020), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you (“User”, “you”) and NT Development Group Pty Ltd (“we”, “us”, “our”). By creating an account, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms.

2. Service Description

InspectAndGo is an AI-powered field inspection platform-as-a-service (PaaS) designed for professionals across mining, residential, commercial, and environmental inspection industries. The Service provides tools for GPS-verified photo capture, voice-to-text transcription, AI-assisted report generation, inspection checklists, job pipeline management, and client booking.

InspectAndGo is part of the AndGo ecosystem of products by NT Development Group Pty Ltd, which includes SignAndGo, ShareAndGo, and BrandAndGo. Cross-product integrations are enabled by default and may be disabled in your account settings.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Promptly notifying us of any unauthorised use of your account.
• Ensuring that your account information remains accurate and up to date.

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Subscription Plans & Billing

InspectAndGo is available under the following subscription tiers:

A 20% AndGo bundle discount is available when you subscribe to multiple AndGo ecosystem products (InspectAndGo, SignAndGo, ShareAndGo, BrandAndGo).

Subscriptions are billed monthly or annually in advance. All prices are in Australian dollars and are inclusive of GST where applicable. Payments are processed securely through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to modify pricing with 30 days’ notice. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload, transmit, or store content that is defamatory, obscene, fraudulent, or infringes on the rights of others.
• Attempt to gain unauthorised access to other users’ accounts, data, or systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools (bots, scrapers) to access the Service without prior written consent.
• Falsify GPS data or inspection evidence to misrepresent inspection findings.

6. Intellectual Property

The Service, including its software, design, logos, trademarks, and documentation, is the intellectual property of Interetail Pty Ltd and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your subscription. This licence does not grant you ownership of any intellectual property in the Service.

7. Data Ownership

You retain full ownership of your inspection data. This includes all photographs, audio recordings, written notes, checklist responses, reports, and any other content you create using the Service.

By using the Service, you grant us a limited licence to process, store, and display your data solely for the purpose of providing the Service to you. We will not sell, share, or use your inspection data for any purpose other than delivering and improving the Service.

You may export your data at any time using the platform’s built-in export features. Upon account termination, your data will be retained for 90 days to allow for export, after which it will be permanently deleted.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Australian Privacy Principles.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Interetail Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including guarantees as to the quality and fitness of the Service.

10. Indemnification

You agree to indemnify and hold harmless NT Development Group Pty Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may terminate your account at any time through the platform settings or by contacting us. We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days to allow for export. Sections that by their nature should survive termination (including Intellectual Property, Data Ownership, Limitation of Liability, and Indemnification) shall survive.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Northern Territory, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of the Northern Territory and any courts of appeal therefrom.

13. Dispute Resolution

In the event of a dispute arising from these Terms or your use of the Service, we encourage you to contact us first to seek an informal resolution. If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered in Darwin, Northern Territory, before commencing legal proceedings.

Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting a notice within the platform or sending an email to your registered address at least 14 days before the changes take effect.

Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must cease using the Service and close your account.
